What you may do with 3D model files from Matrix3D.shop: print a model for your own personal use and, unless the product page says personal use only, use it in your own digital projects, also commercially. Fan art is for personal use only, unless its product page says otherwise. Never share, resell or upload the files, sell prints without a commercial print licence, or use them for AI training or NFTs. The copyright stays with us; the licence ends after a full refund or a serious breach.
The summary is for convenience; the full text below is what applies.This licence sets out what you may do with the 3D model files, such as STL, 3MF, OBJ and FBX files, that you buy or download from Matrix3D.shop. It is part of your purchase, together with our terms and conditions. It is linked on the product page of every model, so please read it before you buy. Nederlandse versie.
The main points
- You may 3D print a model for your own personal use. Unless the product page says the model is for personal use only, you may also use it in your own digital projects, such as games and animations, also commercially.
- Models the product page marks as personal use only, and fan art unless its product page expressly says otherwise, are only for your own, non-commercial use.
- You may never share, resell or upload the files, sell prints without a commercial print licence, or use the files for AI training or NFTs.
- The copyright stays with us. You buy a licence, not the model.
- If we refund the whole price, or you seriously break this licence, the licence ends and you must delete the files.
These points are a summary; the full text below is what applies.
1. When this licence applies
This licence is between you and Matrix3D.shop; our company details are in section 1 of our terms and conditions. It applies to every 3D model file you get from our shop. For a paid model it starts when your order has been paid in full.
It does not apply to prints you buy from us (those are products: see our terms), or to designs and files we make for you on commission. For commissioned work, the quote says what you may do with the result.
Each product page says which of the two licences below applies to that model: the standard licence or the personal-use licence. If the product page sets stricter rules for a specific model, those rules apply. If the product page gives you more rights for a specific model than this licence, those rights apply to that model.
A consumer is someone who buys for purposes outside their trade, business, craft or profession. Section 9 applies only to business customers.
2. The standard licence
Unless the product page says the model is for personal use only, you get the standard licence. It lets you:
- 3D print the model for your own personal use, as often as you like;
- have a print service print it for your own personal use, as long as the service uses the file only for your order and does not keep it;
- change the model for your own use, for example scale it, split it, add supports or combine it with other parts. A changed version falls under the same rules as the original;
- use the model in your own digital projects, such as games, animations, films, renders and visualisations, also commercially, under the conditions in section 4;
- share photos and videos of your prints and of your projects, for example on social media.
Mentioning Matrix3D.shop as the creator is appreciated, but not required.
3. The personal-use licence (fan art and print-only models)
Some models are for personal use only; the product page says so, for example for models made only for 3D printing. Fan art, meaning models based on characters, props, logos or brands of others, is for personal use only, unless its product page expressly says otherwise. With the personal-use licence you may:
- 3D print the model for your own personal use, also through a print service as described in section 2;
- paint, finish and change your own prints;
- use the model in your own non-commercial digital projects that you do not publish or distribute, such as your own renders, unless the product page says the model is for 3D printing only;
- share photos and videos of your own prints and renders, as long as you do not use them commercially.
You may not use these models commercially in any way, also not in games, animations or other projects that you sell or that earn money, and you may not publish or distribute a project that contains the model.
We cannot give you any rights in someone else’s characters, props, logos, brands or trademarks. Fan art is not made, approved or endorsed by the owners of those rights.
4. What is never allowed
Under both licences, you may not:
- sell, rent out or otherwise commercially distribute prints of the model, unless the product page offers a commercial print licence and you bought it; the product page then states its limits;
- share, sell, give away, lend or upload the files, or a changed version of them, other than to a print service as section 2 allows; for example, not to a 3D model website or marketplace, a file-sharing site, a public cloud folder or a chat group;
- offer the model, alone or with other models, in an asset pack, model library, template, mod, subscription or bundle, or in any other form from which others can get the file or print it;
- use the files, or renders or photos of the model, to train, fine-tune or test artificial intelligence or machine-learning systems, or put them in a dataset;
- turn the model, or images of it, into NFTs or other blockchain tokens;
- use the model as a logo or trademark, or as part of one, or say that you designed it.
Where the standard licence allows use in a digital project, the model must be built into your game, animation, render or other project, in a way that does not let others easily get the model file out of it, for example because it is packed or compiled into your game’s files. Your project may not itself be mainly a way to sell or share the model.
These rules also apply to changed versions of the model. Need another use, for example a commercial print licence? E-mail support@matrix3d.shop and we tell you whether that is possible and what it costs.
5. Ownership
The copyright and our other rights in the models stay with Matrix3D.shop. You buy a licence to use a model, not the model itself or its copyright. Your licence is personal and non-exclusive: we may license the same model to others. You may not transfer your licence or the files to someone else. The licence has no end date, unless it ends under section 8.
We expressly reserve our models, renders and product images against text and data mining, including for training AI (article 15o of the Dutch Copyright Act, Auteurswet). Nobody may use them for that without our written permission.
6. Before you buy: check the product page
The product page shows what you get: the file formats, whether the model is made for 3D printing or for games and renders, whether it includes textures, UVs or an animation, and, for printing, the size and whether you need supports or assembly. Please check that your printer, slicer or other software can handle these files. You can turn most models around in 3D on the product page before you buy.
Unless the product page says otherwise, prints made from our models are decorative and hobby items. They are not designed or tested as toys for children under 14, for contact with food or drink, for carrying loads, or for any use where breaking could cause injury or damage. How strong and safe a print is also depends on your printer, material and settings. Please do not use prints for such purposes.
7. If a file does not work
A model must match its description on the product page and work as you may reasonably expect in software that meets the requirements stated there. If it does not, you have the rights in section 12 of our terms and conditions: tell us at support@matrix3d.shop and we fix or replace the file free of charge. If we cannot or will not do that, it takes too long or causes you serious inconvenience, it does not solve the problem, or the problem is serious, you get a price reduction or, unless the problem is minor, your money back.
To find the cause, we may ask you for information about your setup, such as the slicer or program and its version, an error message, a screenshot or the settings you used. We use the least intrusive way and never ask for access to your computer. If you do not help us and the cause may lie in your own setup, you may have to show that the file was faulty when you received it.
We are not liable to the extent that damage is caused because a model or a print was used for a purpose other than its normal use or the use stated on the product page, against our instructions or warnings, or after you changed it yourself. This does not limit our responsibility for faults in our own files, or your rights under the law.
8. When your licence ends
Your licence for a model ends:
- when we refund the whole price of that model, for any reason, for example because you withdrew where that right applies, because the file was faulty or as a goodwill gesture, or when we cancel the order for that model under section 4 of our terms and conditions;
- when you seriously break this licence. If the breach can be put right, we first e-mail you and give you 14 days to do so. If it cannot be put right, for example because you shared, sold or uploaded the files, we can end the licence straight away by e-mail.
When your licence ends, you must stop using the files, delete your copies, not share them and not make new prints from them. We may block your downloads of that model. A price reduction does not end your licence.
If you reverse a payment for a model you received as agreed (a chargeback), we may suspend your licence and block the download while the dispute runs. If the payment is restored, or the dispute ends in our favour, your licence continues and we unblock the download. If the money does not come back to us, we send you a reminder; if you do not pay within 14 days after it, we may end your licence by e-mail. This does not affect our right to claim what you owe us under the law.
Sharing or selling our files without permission infringes our copyright. We may have copies removed from the places where they were shared and claim the damage this caused us, as the law allows.
Section 9.1 of our terms and conditions lists when a licence ends or is suspended; this section follows it.
9. Extra rules for business customers
If you buy as a business, these rules also apply:
- The licence is for your business. Your employees and contractors may use the model only for your projects; make sure they do not keep or share the files.
- Business customers have no right of withdrawal.
- When the licence ends, you confirm in writing, when we ask, that you deleted all copies.
- You indemnify us against claims of others that result from how you used the model or prints made from it, for example in your own products, or from changes you made to it.
- If you share, resell or upload a model, or use it beyond this licence, we may end the licence at once, without a refund (section 20 of our terms and conditions); the 14 days in section 8 do not apply to you.
10. Liability
If you are a consumer, we are liable as the law provides. If you buy as a business, section 13.2 of our terms and conditions limits our liability: in short, to the amount you paid for the order concerned, with no liability for indirect damage, and a claim must be reported within 12 months. These limits never apply to damage caused by our intent or gross negligence, or where the law does not allow a limit. Section 13 of our terms and conditions decides on liability.
11. Applicable law and court
Dutch law applies. If you are a consumer living outside the Netherlands, you also keep the protection of the mandatory rules of the country where you live.
If you are a consumer, disputes go to the court the law designates: you can take us to court in the Netherlands or where you live, and we can only take you to court in the country where you live. If you buy as a business, disputes go to the competent court in the district where Matrix3D.shop is established, unless the law gives another court jurisdiction in a way that cannot be changed by agreement, and the UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. Section 19 of our terms decides.
12. This licence, our terms and later changes
This licence and our terms and conditions together form the agreement about a model. On the legal guarantee, liability, the applicable law and the competent court, our terms apply. Your rights under mandatory consumer law always remain.
The English text is binding. The Dutch version is a translation. If the two differ, the English text applies, unless you are a consumer and the Dutch text is more favourable to you. If you are a consumer and a point is unclear, it is read in the way that is most favourable to you.
We may update this licence. The date at the top shows the latest version. The version that was valid when you placed your order applies to that order, and we do not change the licence of a model you already bought to your disadvantage without your consent. Orders placed before this licence page was first published fall under the licence that applied then (the 3D Model License Agreement, version 1, PDF), as far as the law allows; where this licence is more favourable to you, you may rely on it instead. E-mail us and we send you the version that applied to your order.
If we transfer our business, we may transfer this licence and our obligations under it to the new owner of the business; your rights stay the same (section 18 of our terms and conditions).
